2. Scope and Acceptance of Terms
This document regulates the access and use of the Site, as well as the request and provision of services confirmed by the Provider.
By using the Site you confirm that you have read and understood these Terms and Conditions. Acceptance of an offer or confirmation of a service order produces the contractual effects provided for in this document and in the offer communicated to the Client.
If you do not agree to these terms, do not use the Site to contract for services. Simply visiting the Site or submitting a request does not oblige the Client to contract a service, nor does the Provider accept the request.
All the mandatory rights provided by consumer protection legislation apply to Consumers. Nothing in this document limits or excludes these rights.
3. Services provided
Depending on availability, the specific situation and the necessary technical means, the services may include:
- towing and transporting motor vehicles;
- roadside assistance and car repair;
- starting the vehicle when the battery is discharged;
- towing, recovery or returning the vehicle to the roadway;
- transport of damaged, defective or unregistered vehicles, in accordance with the law;
- other related services expressly confirmed to the Client.
The list on the Site is general in nature. The provider confirms for each request the service that can be performed, the price or method of calculation, the place of intervention, the destination and, if possible, the estimated time of arrival.
The provider can justifiably refuse a request when the intervention would be illegal or unsafe, when there is no availability, when the information communicated is insufficient or inaccurate or when the vehicles and equipment available are not suitable for the situation found.
4. Requesting a service
Services can be requested by phone at0770 423 003, through the contact form, by e-mail or through the other means of communication displayed on the Site.
For the evaluation and organization of the intervention, the Client may be requested:
- name and contact details;
- the exact location of the vehicle and the requested destination;
- make, model, approximate mass and registration number of the vehicle;
- the condition of the vehicle and the nature of the breakdown or damage;
- information about access, vehicle position, locked wheels, locked steering, ground clearance, technical changes, load or other relevant circumstances;
- photographs of the vehicle and the scene of the intervention, if necessary;
- billing data and other information legally required to perform the service.
The customer must communicate correct and complete information. An offer made on the basis of incomplete or inaccurate information can only be revised after the reason has been explained and after the Customer has accepted the new price or the updated method of calculation.
5. Offer and conclusion of the contract
The information and indicative rates published on the Site do not automatically represent a definitive contractual offer for any intervention.
Before accepting the service, the Provider communicates to the Client, depending on the available information:
- the main characteristics of the service;
- the identity and contact details of the Provider;
- the total price, if it can be determined in advance, or the method of calculation;
- foreseeable additional costs;
- the method of payment and the relevant conditions of execution;
- estimated time of arrival, if determinable;
- cancellation conditions and, where applicable, information regarding the right of withdrawal.
The Customer's request is accepted only when the Provider expressly confirms that it can perform the service and communicates the price or method of calculation. For distance contracts, confirmation of acceptance is sent on a durable medium, such as e-mail or a message that can be kept by the Customer, under the conditions provided by law.
If the offer has a validity period, it will be specified at the time of communication. Subsequent modification of the service, route, destination or intervention conditions is made with the agreement of the parties.
6. Prices and additional costs
The price of the service is determined according to the particularities of each intervention. When calculating, the following can be taken into account, as appropriate:
- travel distance and transport distance;
- vehicle type, mass, dimensions and condition;
- the position of the vehicle and the difficulty of loading or recovery;
- additional equipment and operations required;
- waiting time attributable to the Customer;
- time slot, public holidays and weather or traffic conditions;
- road, bridge, highway, parking or access fees;
- the destination and any additional requirements accepted by the Customer.
The price communicated to the Consumer includes all applicable taxes and costs that can be reasonably calculated at that time. If the exact price cannot be determined in advance, the Provider communicates the method of calculation and the existence of any additional costs.
No optional service or additional cost will be added without the Customer's express knowledge and consent. If, on site, circumstances different from those initially communicated are found, the Provider will explain the necessary operations and their cost before continuing the intervention. The Client can refuse the additional costs, in which case the Provider can stop the intervention if it cannot be continued safely and under the original conditions.
7. Estimated time of arrival and execution of the service
Any arrival time communicated is an estimate based on information available at the time. It may be influenced by traffic, weather, traffic restrictions, accidents, works, distance, ongoing interventions or other circumstances beyond the reasonable control of the Provider.
The Provider will use reasonable diligence to comply with the estimate and will inform the Customer, when possible, of known significant delays.
The service is performed using the method and equipment considered suitable for the situation found, in compliance with legal and safety requirements. The provider can suspend or refuse to continue the intervention if there are risks for people, vehicles, goods, equipment or traffic.
The place of delivery of the vehicle is the one agreed with the Customer. Any change of destination may change the price and must be accepted by both parties.
8. Customer Obligations
The customer has the obligation:
- to provide complete and correct information about the vehicle and the intervention;
- to confirm that he is the owner of the vehicle or that he has the necessary right and authorization to request the intervention;
- to present, upon request, the necessary documents to verify the vehicle and the right of disposal over it;
- to inform the Provider about failures, breakdowns, changes, loads or circumstances that may influence the safety of the operation;
- to comply with the safety instructions of the intervention personnel and not to enter the work area without permission;
- to remove valuables, money and personal documents from the vehicle that should not remain in it;
- ensure that the goods carried in the vehicle are legal and, if they remain in the vehicle, are properly declared and secured;
- to pay the agreed price and accepted additional costs;
- be available at the contact details provided or designate a person who can hand over and pick up the vehicle.
The customer must not stay in a dangerous area of the roadway. In case of immediate danger, the priority is to protect people and comply with the instructions of the authorities and emergency services.
9. Photographs and ascertainment of the condition of the vehicle
Before, during or after the intervention, the Provider can take photos or recordings of the vehicle and the work area, to the extent necessary for:
- documenting the condition of the vehicle and pre-existing damages;
- the choice and justification of the intervention method;
- execution and proof of service;
- preventing or resolving complaints;
- fulfilling legal obligations and defending the rights of the Provider or the Client.
These materials are processed in accordance with the Privacy Policy and are not used for advertising purposes without an appropriate legal basis.
The customer is encouraged to check the condition of the vehicle upon delivery and collection and to report any problems noticed without delay. Failure to report immediately does not waive Customer's legal rights.
10. Cancellation of request and impossibility of execution
The customer can cancel the request before the offer is accepted without cost.
If the cancellation occurs after the acceptance of the service and after the departure of the crew, the Provider can only request the reasonable cost of the trip or of the operations already performed, if the existence and method of calculation of this cost have been communicated and accepted in advance by the Client and if the law allows its collection.
If the crew cannot identify the vehicle, cannot contact the Customer or is kept waiting for reasons attributable to the Customer, a travel or waiting cost may be applied only if it has been communicated and accepted in advance.
If the Provider can no longer perform the service for reasons attributable to him, the Client does not owe unperformed services, and the amounts collected for them will be returned without undue delay.
11. The Consumer's right of withdrawal
For remote or off-premises contracts, the Consumer benefits, in the cases and conditions provided by GEO no. 34/2014, of the right to withdraw from the contract within 14 days from the date of its conclusion, without being obliged to justify its decision.
Considering the nature of the towing and roadside assistance services, the Consumer usually requests the start of the intervention before the expiry of the withdrawal period. In this situation, the Provider requests the Consumer:
- the express request that the provision of the service begins immediately or before the expiration of the withdrawal period; and
- confirmation of the fact that, after the full execution of the service, the Consumer loses his right of withdrawal, in accordance with the law.
If the Consumer exercises his right of withdrawal after having requested the start of the service, but before the full execution, he may owe an amount proportional to the services actually provided until the communication of the withdrawal, when the legal conditions are met.
The right of withdrawal can no longer be exercised after the full provision of the service, if the execution began with the prior express consent of the Consumer and after confirmation by him that he understood the consequence of losing the right of withdrawal.
To exercise the right of withdrawal, the Consumer can send an unequivocal statement tocontact@petricatractariauto.ro, indicating the name, contact details and service to which the request relates.
12. Payment and fiscal documents
Payment is made by the method communicated by the Provider and accepted by the Client before the service is performed or at the time agreed by the parties.
The provider issues a tax invoice, tax receipt or other document provided by law, as the case may be. The customer must correctly and completely provide the information necessary for the issuance of tax documents.
The customer owes only the price and additional costs that have been communicated and accepted, under the terms of this document and the law.
13. Liability of Parties
The provider is responsible for the execution of the service in accordance with the applicable legislation and with the reasonable diligence specific to the activity of towing and roadside assistance.
The provider is not responsible for pre-existing damage, hidden defects, internal defects, wear and particulars of the vehicle that were not caused by its operations. Also, the Provider is not responsible for the consequences of inaccurate or incomplete information provided by the Client, to the extent that the damage was not also caused by the fault of the Provider.
The provider does not guarantee the repair of the vehicle by simply towing, towing, starting or roadside assistance. If the problem cannot be fixed at the scene of the intervention, the vehicle can be transported to the agreed destination.
The provider does not carry out an inventory of the goods left in the vehicle unless the parties expressly agree otherwise. This provision does not exclude the Provider's liability for losses or damages caused by its fault and does not limit the Consumer's legal rights.
The customer is responsible, according to the law, for damages caused by false information, hiding risks, violating safety instructions or requesting an operation on a vehicle for which he has no right to dispose.
Nothing in this document excludes or limits liability in cases where such exclusion or limitation is prohibited by law.
14. Contributors and Third Parties
The provider may use employees, collaborators or subcontractors to perform the service, depending on availability and the requirements of the intervention. Their use does not diminish the rights of the Client and does not remove the liability of the Provider according to the law and the contract.
Services provided directly by third parties, such as repairs carried out by a car service chosen by the Customer, are subject to the conditions of that provider. The Provider does not become a party to the contract between the Client and the third party just because he has transported the vehicle to his premises or provided his contact details.

The content of the Site, including texts, graphics, logos, photos, video materials and its structure, is protected by copyright and intellectual property legislation, to the extent that it belongs to the Provider or is used under a valid right.

18. Force majeure and fortuitous event
Neither party is liable for non-performance of obligations when it is caused by a legally recognized force majeure event.
To the extent permitted by law, the affected party will notify the other party within a reasonable time and will use efforts to limit the effects of the event. If performance is no longer possible, the Client will not owe the part of the service that was not provided.
19. Modification of Terms and Conditions
The provider may update this document for the future, including in the event of changes to services or legislation. The updated version will be published on the Site together with the date of the last update.
The changes do not retroactively affect contracts already concluded. The version communicated or available to the Customer at the time of its acceptance, together with the confirmed individual offer, applies to an order.
